1. Introduction
Welcome to PixelSphereEcho ("us," "we," or "our"). These Terms & Conditions ("Terms") apply to your use of our yacht hire services and the website found at pixelsphereecho.sbs, provided by PixelSphereEcho.
By reserving a yacht or using our Service, you consent to be governed by these Terms. Should you reject any section of these terms, you are not permitted to use the Service.
2. Service Overview
PixelSphereEcho offers an array of luxury yacht chartering services, among them:
- Yacht rentals for daily use
- Evening boat trips
- Business getaway packages
- Exclusive gatherings
- Lengthy yacht voyages
Availability of services depends on various factors and may change. We hold the right to modify or discontinue services without notice.
3. Booking and Reservations
3.1 Booking Process
To secure a yacht reservation, you are required to:
- Be over 18 years of age
- Supply valid and thorough information
- Make a deposit according to the booking confirmation
- Conform to these Terms & Conditions
3.2 Confirmation
Your booking is regarded as confirmed after payment is received along with our written confirmation. We reserve the authority to refuse service at our discretion.
3.3 Availability
All yacht charters are contingent upon availability of vessels and favorable weather conditions. We aim to accommodate your preferred timing and dates whenever possible.
4. Payment Terms
4.1 Pricing
All prices are provided in € and encompass applicable taxes unless noted otherwise. Price alterations may take place without prior notification.
4.2 Payment Schedule
- Deposit: Half of the entire yacht charter fee required at the time of reservation
- Remaining balance: To be paid 48 hours ahead of the charter departure time
- Further fees (if any): To be settled at the conclusion of the charter
4.3 Payment Methods
Major credit cards, bank wires, and certified cheques are accepted as payment. Transactions are processed using secure and encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Up until 72 hours prior to departure: Entire payment returned minus service fees
- From 24 to 72 hours before departure: 50% of the payment is refundable
- Less than 24 hours prior to departure: No refund provided
5.2 Weather Cancellations
If weather conditions are considered unsafe by our captain, options provided include:
- Rescheduling your charter to an alternative date with no extra charges
- A complete refund in case rescheduling is not an option
5.3 Mechanical Failures
In the rare event a mechanical failure occurs with the designated yacht, we will make an effort to supply an appropriate replacement. If a replacement is not available, you will be issued a complete refund.
6. Safety and Behavior
6.1 Safety Regulations
Passengers must adhere to the following:
- Heed all directions from the crew
- Use safety equipment as required
- Disclose any health conditions potentially affecting their safety
- Stay within designated vessel zones
6.2 Restricted Items
The following are not allowed on board:
- Glass bottles
- Illegal items
- Weapons of any type
- Excessive amounts of non-alcoholic drinks beyond what is considered standard consumption
- Animals (unless granted permission)
6.3 Conduct
Guests must behave in a courteous manner at all times. A charter can be ceased prematurely without a refund if a passenger's conduct poses a danger or disturbs others.
7. Liability and Insurance
7.1 Our Accountability
We limit our responsibility to the payment made for your yacht hire. We are not accountable for:
- Injuries due to a passenger's carelessness
- Personal belongings lost or damaged
- Secondary, consequential, or exemplary damages
- Delays induced by weather or other factors out of our control
7.2 Insurance Protection
We hold a comprehensive marine insurance policy for our fleet and operations. It is the passengers' responsibility to procure their individual travel and personal insurance coverage.
7.3 Acceptance of Risk
Engaging in our yacht services signifies your recognition of the inherent perils of maritime activities and your assumption of personal risk for your safety and security.
8. Adjustments and Itinerary Alterations
At our discretion, we may revise itineraries, pathways, or schedules due to considerations related to weather, safety, or operational needs. We will make every effort to ensure comparable alternative experiences.
9. Force Majeure
Circumstances outside our control, including but not restricted to, the following may lead to delays, cancellations, or changes for which we are not liable:
- Severe meteorological situations
- Natural catastrophes
- Governmental directives
- Harbor shutdowns
- Vessel malfunctions
10. Privacy and Data Safety
Handling of your personal data complies with our Privacy Policy. Utilizing our services, entails your agreement to the collection and utilization of your information as outlined in our Privacy Policy.
11. Intellectual Property
The content on our website, such as texts, visuals, symbols, and pictures, is safeguarded by intellectual property laws. Reproduction, dissemination, or the creation of derivative works without our express consent is prohibited.
12. Governing Law
These Terms are subject to laws prevailing in Germany. Any conflicts will be settled in the judicial courts of Hamburg, Germany.
13. Alterations to Terms
We have the authority to amend these Terms at any time. Notification of changes will be displayed on our website with an updated date of revision. Continued use of our services signifies acceptance of the new terms.
